LIABILITY WAIVER AND RELEASE
I have read and agree to the following:
Risk of Motorcycle Touring - I hereby represent and acknowledge that I am fully knowledgeable of the dangers associated with riding motorcycles, including the possibility of personal injury, property damage and even death. I am duly licensed and possess the abilities and skills necessary to operate a large (over 750 cc) motorcycle in a safe and cautious manner, that I have at least two (2) years experience with above types of motorcycles and I accept full, complete and personal responsibility for the safe operation of my motorcycle while participating in the Tour. I, my dependents, heirs and assigns hereby release and hold harmless About Time Automotive, L.L.C. and any staff members of the company against any and all claims, causes of action, or any other liability of any kind arising from my activity of touring by motorcycle. I know of no physical or mental impairment that may affect my safety, the safety of my passenger or the group.
Safety - On every About Time Tour, the safety of our participants and staff is of the utmost importance. While on the Tour, the decision of whether or not I wear a helmet or other protective equipment is solely my own and I will be responsible for compliance with all state laws, including those regarding use of helmets and other safety equipment. Further, I certify that I will not at any time during the Tour operate a motorcycle under the undue influence of alcohol, narcotics, or other substances which may impair my ability to operate a motorcycle safely. Any person found to be operating a motorcycle or other vehicle while under the influence of any such substance may be dismissed from the Tour immediately, without refund or credit of any kind. About Time Tours reserves the right to require a client to ride in the support vehicle and remove them from the motorcycle, if their actions pose a potential threat to themselves or any other rider.
Unforeseen Circumstances and Force Majeure - I agree to hold About Time Automotive, L.L.C. harmless for any failure, delay, acts of omission or commission and any resulting loss or damage occurring during the Tour, or as a result of the Tour, through the actions of third parties, including, but not limited to, the operators of hotels and restaurants, carriers, and other suppliers and vendors engaged by About Time Automotive, L.L.C. Or its subsidiary About Time Tours. This includes damage or loss due to governmental action, weather, mechanical breakdown, equipment failure, labor disputes, sickness, acts of War, acts of God, or other causes beyond the direct control of About Time Automotive, L.L.C.
Photography - My submission of this registration form also confirms my voluntary and permanent consent for About Time Automotive, L.L.C. and it’s assigns to use and re-use my photograph in any form including, but not limited to sales promotions, marketing, advertising, and public relations material created on behalf of About Time Automotive, L.L.C. or its subsidiary About Time Tours.
TERMS & CONDITIONS
Payment - A deposit of $750.00 per person is necessary to hold your position on the Tour. The full tour price must be paid by the Full Payment End Date listed for your tour. About Time Tours may cancel your reservation if payment is not received by that time. All prices are in US dollars. We accept MasterCard and Visa for Reservation Deposits and tour payment. However, personal or bank check, Money Order, or Electronic Funds Transfer are preferred for final payment.
Room Occupancy - Single Rider Double Occupancy pertains to a single rider sharing a room with another single rider. As a Single Rider you have the right to request your own personal accommodations, referred to herein as Single Occupancy. This option has an additional cost of $550.00 above the listed tour price. Two Couple Double Occupancy pertains to a pair of couples sharing one room. This option is only for couples who are friends, and who register and book at the same time. This option is a $480.00 savings on the listed tour price.
If you would like to arrange for additional nights before or after the tour dates, we will make all the necessary arrangements on your behalf. Any cost for additional nights before or after published tour dates are not covered in tour pricing and will require additional funds. If you are arriving before or leaving after any published tour dates, transportation to and/or from the airport to your accommodations will be your responsibility.
Refunds and Cancellations - Participants who cancel a reservation will receive refunds as follows: Your deposit is refundable up until the registration "end date" for your tour, less a $150.00 per person fee. If you cancel after the "full payment date", but 30 days days prior to the tour date, we will refund 60% of the tour price. No refunds will be made for cancellations less than 30 days before the tour date. If About Time Tours cancels a tour for any reason, all the money you have paid will be refunded, or you may join another tour. We do not refund the cost of “nonrefundable” airline tickets. If an alternate tour is selected, any difference in cost must be paid or will be refunded.
We recommend that tour participants consider purchasing trip insurance to protect themselves from financial loss due to the unexpected cancellation or interruption of your trip, or other covered circumstances.
Our Responsibilities - All About Time Tours are continually refined and updated to maximize the safety and enjoyment of our guests. We reserve the right to modify, without notice to tour participants, any tour as needed to accommodate operating needs or circumstances beyond our control. This includes, but is not limited to, hotel and dining arrangements, routes and itinerary. In the event substitutions are made, we will strive as far as practical to insure that all features of the tour are of similar or better quality than those originally planned. We will transport your luggage in our support vehicle and/or trailer, but accept no claims or responsibility for costs or damages related to lost or damaged baggage, other than to provide reasonable care and security for your property.
While About Time Automotive, L.L.C. is acting as my agent to obtain accommodations and meals, provide guide services, and may assist me in obtaining a rental motorcycle for this Tour, I understand that About Time Automotive, L.L.C. and its subsidiary About Time Tours has no affiliation with any motorcycle rental, transport or storage company and they assume no responsibility for services (or lack thereof) provided for motorcycle rental. I hold About Time Automotive L.L.C. harmless against any and all claims, causes of action, or liability of any kind arising from the rental, transport, or operation of a motorcycle.
Weather - We schedule our tours at times when weather is reasonably expected to be suitable for motorcycle touring in the areas we are visiting. However, on occasion, we may be faced with unfavorable or severe weather, and we are not responsible for delays or modifications due to weather conditions.
Acceptance - These terms cannot be modified except in writing between myself and About Time Tours. Submission of this form, and payment of my deposit and/or tour fees, constitutes acceptance of these Terms.
